The firm has represented commercial clients and individual shareholders in shareholder and contractual disputes, and has defended corporations in a variety of contexts, including nuisance, negligence and consumer fraud act cases. The firm has represented transportation companies ranging from small domestic and Canadian motor carriers to very large national carriers in a variety of litigation matters ranging from simple negligence and cargo claims to the most complex matters involving catastrophic losses and technical compliance with FMCSR and USDOT regulations. The firm offers legal services and expertise in handling state and federal regulatory taxation and compliance audit issues regularly confronted by motor carriers. In addition, the firm represents the personal interests of injured truckers in accident litigation and works cooperatively with counsel in Canada, Vermont and neighboring states to coordinate the successful resolution of customs and immigration issues faced by motor carriers and their employees.
The firm enjoys a long relationship with select insurance carriers operating in Vermont and New England and offers special services and expertise in handling litigation for Canadian insurers and the individuals and businesses they insure when faced with litigation, or the threat of litigation, in the USA. The firm's principals are very familiar with the unique demands of the tripartite relationship between insured, insurer and outside defense counsel. Our clients greatly benefit from both our long experience in ably managing defense litigation and, significantly, our recognized courtroom expertise and skill so necessary to protect the client's interest when a case must be tried to verdict. In addition to offering extensive experience representing insureds in a wide variety of civil actions, the firm also specializes in insurance coverage litigation. The firm has handled, both directly and as local counsel, a significant number of complex coverage actions in which an array of issues has been presented for analysis and resolution.
The firm represents both plaintiffs and defendants in personal injury actions ranging from motor vehicle accidents to catastrophic workplace injuries. We have expertise in marshalling the evidence and resources necessary for the successful handling and resolution of these actions and we have used that expertise to achieve successful results for our clients, both in settlement and at trial.
James Spink enjoys a growing mediation and arbitration practice. Mr. Spink is frequently called upon to mediate civil disputes ranging from commercial litigation matters to a wide variety of personal injury claims. The increasing demand for Mr. Spink's services reflects the Bar's recognition that he brings to the task a balanced perspective gained over twenty years of practice and an active commitment to both neutrality and the goal, shared by the disputing parties, of bringing about a resolution of the particular dispute. Mr. Spink has served both on arbitration panels and as an individual arbiter in civil disputes and has successfully helped civil litigants resolve numerous cases at mediations in the federal court, known as Early Neutral Evaluations, and in state courts throughout Vermont.
